The following policies and guidelines have been written to balance the requirements of individual participants and Massage Time Australia Pty Ltd T/A Be Activated Australia as a business entity. Primarily, these terms and conditions exist so as to release staff from having to enter into judgements about a registrants individual circumstances.
1.0 TERMS AND CONDITIONS
1.1 Please read the following terms and conditions so that you fully understand what is required of you and what you can expect from us, Massage Time Australia Pty Ltd T/A Be Activated Australia.
1.2 By booking a course with us you are agreeing with the following terms and conditions.
1.3 If you have any questions about these terms please do not hesitate to contact us.
1.4 The purchase of any course or product via this website is a business to business contract whereby the following terms and conditions apply in accordance with Australian State and Territory Law.
2.1 The full workshop / course fee is due at the time of booking except if you are selecting to a SplitPay payment option. In this case, payments are generally made monthly until the full amount is paid.
2.2 Details appear on the website and/or on your receipt/s.
2.3 You cannot attend a workshop / course until the full amount is paid.
2.4 All payments are transactioned in Australian dollars (AUD).
2.5 A contract will exist as soon as we issue your course confirmation email. 2.6 A certificate of attendance will be issued once you complete the course AND course fees are paid in full.
3.1 Prices quoted on the website are per person include GST and are quoted in Australian dollars (AUD).
3.2 Prices do not include travel to and from the course, accommodation or lunch unless otherwise stated.
3.3 It must be assumed that all payments received will be debited from your account within 5 working days.
3.4 Massage Time Australia Pty Ltd T/A Be Activated Australia will not be held responsible for returned cheques due to insufficient funds being available in your account.
3.5 A $35AUD Bank Chargeback Fee is due for any cheques returned by your bank as unpaid.
3.6 A $75AUD Registration Administration Fee is included in your course fees.
3.7 The Registration Administration Fee incorporates receiving and validating registrations, processing payments, bank charges, sending confirmation information, and person-to-person contact/s.
4.0 CANCELLATION POLICY
4.1 Cancellations must be made in writing.
4.2 If you have registered and paid to attend a Massage Time Australia Pty Ltd T/A Be Activated Australia workshop or course, there are circumstances which allow for refunds based on the time of cancellation, prior to the workshop or course.
4.3 More than 6 weeks prior to workshop / course – cancellation fee is 10% of total paid.
4.4 3-6 weeks prior to workshop / course – cancellation fee is 45% of total paid.
4.5 Less than 3 weeks prior to workshop / course – cancellation fee is 100% of total paid.
4.6 No show at course / workshop – cancellation fee is 100% of total paid.
4.7 The cancellation fee is reflective of proximity to the workshop / course commencing.
4.8 The concept of charging a cancellation fee for non-attendance at a workshop / conference or any healthcare professional appointment is well established in the field of healthcare and other professions.
4.9 It takes into account the notion that services, and/or administration, and/or bank charges have been executed on your behalf, with the understanding that you are going to attend a given workshop / course.
4.10 Whilst it is unfortunate that you may be unable to attend the workshop / course, we hope that you understand that services, fees, and/or bank charges may have been executed on your behalf when we received your registration and / or payment.
5.0 REGISTRANT SUBSTITUTION POLICY
5.1 Requests to substitute a registrant must be made in writing.
5.2 We are able to offer to transfer your registration to a participant who replaces you in the workshop/course.
5.3 This person cannot be a person already registered on the same workshop / course that you were going to attend.
5.4 If you are able to provide a substitute to your course place, if no refund needs to be issued to you, we will change you over free of charge.
5.5 If you require a refund to be issued and the substitute needs to pay, once the substitute has paid, we will change you over and refund you any fees paid.
5.6 The replacement participant will need to pay for the course in full themselves, we cannot transfer credit from your account to theirs.
5.7 If no suitable replacement is offered by you and if the course is full with a waiting list, we will assist in trying to find a replacement, but if none is found, this will be treated as a late cancellation, as per Cancellation Policy, Section 4.6.
6.0 CREDIT POLICY
6.1 Requests for Credit for a workshop/course that you are unable to attend must be received in writing.
6.2 In the event that an event is cancelled you may choose to receive a full refund or apply the credit to another course of the same or lesser value.
6.3 Massage Time Australia Pty Ltd T/A Be Activated Australia are not held liable for any additional expenses you incur through cancelling the event e.g. travel expenses and accommodation.
6.4 If there are circumstances beyond our control which cause you to cancel or change your trip such as war, riot, industrial dispute, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions we will not be liable to pay you any compensation or be liable for any other expenses to you. We may be able to offer a credit for another course of the same of lesser value.
7.0 PAYMENT PROCESSING POLICY
7.1 We do not store any payment credit card details.
7.2 All credit card payments are processed through our website via Stripe or Paypal.
7.3 Please do not email us your debit / credit card details as their security cannot be guaranteed.
7.4 Using credit card facilities incurs fees which we collect as part of Section 3.6
8.1 Your name, email, and / or mobile phone number will be collected to administer your place on the course / workshop during the registration process.
8.2 The information in Section 8.1 will not be rented, loaned, or sold to any third party providers.
8.3 The information collected in Section 8.1 may be used to provide you with other information related to our core business.
9.0 VARIATION POLICY
9.1 Massage Time Australia Pty Ltd T/A Be Activated Australia will endeavour to provide the course as described on the website or any other promotional material.
9.2 Unforeseen circumstances may result in the need to alter the venue, the course content, or the presenter or speaker.
9.3 Any changes will not diminish the overall course outcomes. If any changes are required, you will be notified as soon as possible.
9.4 Massage Time Australia Pty Ltd T/A Be Activated Australia works with a number of other companies and service partners and cannot be held liable for any damages, losses or inconveniences resulting from their action/s.
9.5 Massage Time Australia Pty Ltd T/A Be Activated Australia has developed solid working relationships with many third party vendors and we always ensure any issues are dealt with professionally and as a priority. 9.6 Massage Time Australia Pty Ltd T/A Be Activated Australia have a duty of care to it’s customers, registrants, and staff but have limited liability relating to the cost a workshop/course.
9.7 Massage Time Australia Pty Ltd T/A Be Activated Australia cannot be held responsible for damage and/or loss to your personal possessions.
9.8 Massage Time Australia Pty Ltd T/A Be Activated Australia shall not be liable for failure in carrying out the contract if the failure is due to the action of the participant or the action of a third party.
10.0 OUR RESPONSIBILITIES TO EACH OTHER
10.1 You accept that some courses have a practical component, which if applied inappropriately, may involve elements of risk or discomfort.
10.2 By agreeing to these terms and conditions you take personal responsibility for your own actions.
10.3 Massage Time Australia Pty Ltd T/A Be Activated Australia accept no responsibility for damage, death or injury caused to you or by you as a result of participation.
10.4 You must work within your own ability and scope of practice at all times.
10.5 Massage Time Australia Pty Ltd T/A Be Activated Australia reserves the right to refuse your acceptance on a course if we feel it is outside your scope of practice and may put other participants at risk or injury or discomfort.
10.6 It is your responsibility to ensure you have professional liability insurance to cover you for your attendance at the course and the course content.
10.7 Massage Time Australia Pty Ltd T/A Be Activated Australia reserves the right to refuse entry to a course if you cannot demonstrate you have appropriate liability insurance.
10.8 You must be physically able to partake in the course and if you do have any injuries, discomfort or prior knowledge that is relevant to any activities being performed it is your responsibility to make those known to the course presenter.
10.9 Massage Time Australia Pty Ltd T/A Be Activated Australia reserves the right to remove any person from a course if their behaviour is deemed by the tutor to be detrimental to the group, unsafe or adversely affecting the groups’ enjoyment.
10.10 It is your responsibility to ensure that you are sufficiently fit and adequately equipped to partake on your chosen course.
10.11 You must tell us of any medical conditions or dietary requirements at the time of booking.
10.12 If for any reason you are not in a suitable condition to attend or complete a course or are under the influence of drink or drugs the facilitator or tutor may ask you to leave the course.
10.13 Massage Time Australia Pty Ltd T/A Be Activated Australia will not be liable for any extra expense incurred by this and you will not be able to claim a refund.
10.14 Massage Time Australia Pty Ltd T/A Be Activated Australia will not be liable for any refund in these circumstances.
10.15 Audio and video recording of events is not permitted without the written permission of Massage Time Australia Pty Ltd T/A Be Activated Australia.
10.16 Should you have a problem or complaint on your course you must bring it to the attention of our staff as soon as possible and we will try to rectify the problem.
10.17 If you feel that the problem was not resolved and resulted in a much reduced enjoyment of the course you must inform us in writing within 28 days and we will respond within 28 days to resolve the matter to the satisfaction of both parties.
